PERKOSAAN DALAM RUMAH TANGGA (MARITAL RAPE) DITINJAU DARI KAIDAH ASASIYAH FIQIH “AD-DHARARU YUZALU” (Studi Kasus Kecamatan Pandaan, Kabupaten Pasuruan)

Affection and love that blossomed before marriage can turn into violence and crime after marriage. Married couples can experience sexual violence or rape in the household which is called marital rape. There are many causes and consequences behind and arising from the marital rape case. If this continues, there will be more dangers and an increase in the number of victims of sexual rape in the household. In this study, researchers have reviewed how the role of fiqih principles ad-dhararu yuzalu if implemented in the case of marital rape. The research used by the researcher is Field Research. This research is a qualitative research with a normative-empirical approach. Interviews and collection of literacy resources were carried out in research to achieve maximum results in research. The results of the study indicate that the act of marital rape can cause huge losses that can be physically and psychologically affected by the victim. Marital rape occurs because of many factors in the household that can trigger the violence. The most important factor is the lack of understanding and understanding between each other so that there is a pattern of communication and unhealthy relationships between the two. According to Ad-dhararu yuzalu's review of the rules of fiqih on marital rape, every danger should be avoided or eliminated. In the implementation of married life, this can be done by not doing things that can trigger household quarrels, and avoiding actions that violate religious and community norms so that the relationship between humans and their God and human-human relations is maintained properly. By successfully avoiding bad things and maintaining good human relations, household integrity and harmony are also maintained
